DALLAS (CBSDFW.COM) – A second Dallas teenager has been sentenced to probation for the near fatal beating of a theater manager in the parking lot of the Target store at CityPlace.

Thursday, 17-year-old Zantrall Sauls was sentenced to ten years probation for the attack on Derek Whitener.

Whitener stopped at the store on January 14, 2017. As he walked through the Target parking lot, two people approached him – one of whom was carrying a wooden rod.

Once inside the store, Whitener told employees and store security about what happened. They told him he didn’t need to call police and promised to handle the situation. Store security asked the would-be assailants to leave and later assured Whitener it was safe for him to exit the store.

When the artistic and education director of The Firehouse Theater in Farmers Branch left the store the men reappeared, one wearing a gorilla mask, and viciously beat him with the rod.

Whitener’s father, Grady, said the attack on his son left him with permanent brain damage and that brain surgery was the only thing that saved his life.

Grady Whitener was given the chance to address the man who attacked his son. “There were days that we thought our family was gonna lose him. The seriousness of this is just unfathomable,” he said. “I can’t fathom and neither can he or any member of our family and I know I’m not gonna get an answer today but, why could two people, you and your co-conspirator, decide your just gonna [say]… ‘I know I got an idea. Let’s get some masks and let’s get an improvised weapon and let’s just go out and try to kill two or three people tonight.”

He went on to say that Sauls and his accomplice are getting off the hook easy. “When you go and you commit two or three felonies… that was 20 years each and you’re getting probation. And we have the other offender, your co-conspirator; the judge herself even said ‘when he goes to placement for four months and comes out a model citizen we will celebrate him.’ She said those words. So, there is no justice that Derek has received.”

Grady Whitener said while the offenders were sentenced to short probation and will soon go on with their lives, his son will never fully recover from his injuries.

Marcus Fowlers, Saul’s father, said he has an idea of what the Whitener family is going through. “I’m a former victim also,” he said. “I wanted you to hear it from me, from his family, that I apologize.”

After Sauls was sentenced Dallas County District Attorney Faith Johnson issued a statement that said, in part –

“With the victim’s approval, Sauls was sentenced to 10 years deferred adjudication with 4 months of jail time as a condition. The victim is focused on his recovery and putting this vicious crime behind him.”

DALLAS (CBSDFW.COM) – Police arrested a homeless man after they say he assaulted two women with a knife in downtown Dallas on Sunday.

Police say the man, 22-year-old Brandon Holbert, approached three women just after 12:20 p.m., at the intersection of Main Street and North Ervay Street.

According to police, Holbert accused the women of taking a picture of him and while ranting pulled out a pocketknife and began making threats.

Police say two of the women ran from the suspect and into the Wilson Building in the 1600 block of Main Street. Holbert allegedly cornered them in an elevator and cut them with a knife on the face, arms and shoulders.

One of the victims was able to escape the elevator and ran out of the building. The other woman was taken to an apartment inside the building by a witness.

Good Samaritan Michael Osman told a CBS 11 News crew that he was out walking his dog when he saw what appeared to be a group of defenseless women who were under attack. “When I walked outside there was a guy on the corner he had ripped his backpack off and started screaming about a cell phone and then just punched the woman in the face,” he said.

Osman said he did his best to keep the man out of the building, but to no avail. “When he came in following… he stuck his foot by the door [and] stopped me from pushing the door shut, so he’s real skinny [and] he just squeezed his way right pass me.”

Police were called and Holbert was arrested. Today he is facing several charges including two counts of aggravated assault.

The injuries the women sustained were not life threatening.

Rockwall Police said the suspect began to ram his vehicle into police vehicles, and an officer on the scene shot the suspect.

“He began ramming his vehicle at the police vehicles at the scene. One officer deployed a less lethal weapon to try to stop him. Apparently it did not stop and he deployed his service weapon,” said Jeff Welch of the Rockwall Police Department.

The suspect was rushed to a hospital where he was pronounced dead.  He has not yet been identified.

The incident remains under investigation by the Texas Rangers and the Rockwall Police Department Internal Affairs unit.

IRVING (CBS11) – An 85-year-old grandmother is recovering after police say she was kidnapped from her home and then stabbed and beaten.

The suspect, Lesia Ann Coco, is still on the loose.

Lesia Ann Coco (Irving PD)

The victim’s daughter-in-law believes the 85-year-old was targeted because of a past connection. Coco used to be the victim’s husband’s caregiver.

The marks on the the grandmother’s arm tell a story of survival.

“This is from, I think, punching and stabbing,” said Gail Simmons.

Simmons visited her mother-in-law in the hospital, and she says she got quite a shock.

“When I walked in, I just sobbed and my heart just broke because… she’s an old woman,” said Simmons.

Irving Police say Coco was sitting on the porch Friday just after 9:00 p.m., waiting for the victim and her 89-year-old husband.

“She pushed him in and closed the door – said she knew where her stolen jewelry was,” said Simmons.

The jewelry recently went missing. Police say Coco then whipped out a knife.

“This lady was doing this [makes swinging motion] while she was trying to drive the car,” said Simmons.

Simmons says her mother-in-law started singing “Jesus Loves Me.” She believes faith may have saved her.

“That’s what started the conversation. ‘Do you go to church?’ She said, ‘since you go to church, I won’t kill you,'” said Simmons.

Police say Coco told the victim to stop at a McDonald’s, where she jumped out.

“She did not get away with anything. I think that might be why she said, ‘pull over and let me out,'” said Simmons.

Simmons says her mother-in-law managed to drive to a QuikTrip in Arlington where customers called police.

Simmons doesn’t know how long her mother-in-law will have to stay at the hospital.

GRAND PRAIRIE, Texas (CBSDFW.COM) – Grand Prairie Police have a man in custody after responding to a disturbance at a nail salon in the 5100 block of Magna Carta on Friday morning.

When officers arrived at the nail salon, they were told a man came in with a pistol and began striking at least one female employee with the handgun.

Police said he also tried to start a fire at the nail salon.

A Good Samaritan with a concealed handgun license heard the disturbance and held the suspect at gunpoint until police arrived.

Police took the suspect, identified as Bill Son Nguyen, 47, into custody.

He is charged with murder, aggravated assault and arson.

Bill Son Nguyen – Grand Prairie homicide suspect

The woman who was struck went to the hospital and is expected to be okay.

While all of that was going on, the Grand Prairie Fire Department was putting out a fire in the 2900 block of Hastings Drive where there was a deceased person inside.

Investigators determined that home was connected to Nguyen.

As of 9:00 p.m. Friday, investigators were still out at the home on Hastings where a woman by the name of Chi Pham lived with her kids.

Friends say she is the woman who police found deceased.

Pham was raising her sister’s kids after her sister died last year, friends say.

The last time Lan Vo saw her friend Chi Pham, Pham had a new boyfriend.

“When we last talked, she had just started dating him. She told me that she was in a relationship,” said Vo.

Vo said her friend and single mom, Pham, was excited about the man she had just started dating, Billy Son Nguyen.

They met at the nail salon where they both worked.

Vo hasn’t seen her friend in months, until she heard her house caught fire this morning.

She rushed to the house where family sat on a lawn across from the devastation.

“I saw the house burning, all this smoke coming from the garage,” said neighbor Juan Carrasco.

“Her sister had died from cancer last year and left her three kids, so she is taking care of her own two kids as a single mom and then taking care of her sister’s kids on top of that,” said Vo.

Police said Bill Son Nguyen left Pham’s house after he set it on fire and then went to the nail salon where he pistol-whipped a woman and tried to set the salon on fire.

“I talked to her mom, I hear the kids crying in the back,” Vo said. “The first thing that come to my mind was how does a child deal when they come home to know that their mom is no longer there?”

She left on foot with the children but was later detained by a Harris County deputy constable.

GARLAND (CBSDFW.COM) – A driver who was shot by Garland officers Friday evening led police on a pursuit while there were children in his vehicle, authorities say.

Police say, at around 6:30 p.m. Friday, two officers were stopped in traffic at West Miller and Saturn Road when she saw a Ford Explorer crash through a fence at a cemetery and strike a tombstone.

The officers went to investigate the crash. As they approached the driver of the Explorer, the vehicle backed out and began driving towards the officers.

Fearing for their lives, the officers fired their weapons towards the driver. The driver fled the scene and led officers on a chase before he stopped in a business parking lot in the 2600 block of South Garland Avenue.

The driver exited the vehicle when he stopped and was taken into custody.

Police say after the driver was taken into custody, officers found an 11-year-old and a four-year-old in the back seat of the Explorer. The officers did not know they were in there, according to police.

The driver, later identified as 30-year-old Thomas Christopher Irwin, suffered two gunshot wounds and was transported to a hospital with non-life-threatening injuries.

The children and officers involved were not injured during the incident.

Police say both officers involved were placed on paid administrative leave as per departmental policy.

Through the investigation, authorities believe Irwin was under the influence of drugs at the time of the incident.

Irwin is still in the hospital, but police say, when he is released, he will be charged with aggravated assault against a public servant, two counts of endangering a child, driving while intoxicated and evading arrest.

ARLINGTON, Texas (CBSDFW.COM) – Authorities arrested a man on Saturday after they say he rammed into an Arlington police officer’s motorcycle before fleeing a traffic stop.

Lonnie Johnson, 27, was arrested for aggravated assault on a public servant and evading arrest by the U.S. Marshal’s Fugitive Task Force and Arlington SWAT.

Body-cam footage tweeted by the department shows the incident as it occurred on Thursday. The officer stopped the vehicle and parked his motorcycle behind it. The officer then approached the driver’s side.

The 27-year-old was later found on Saturday.

“Today with the help of the U.S. Marshal’s North Texas Fugitive Task Force along with Arlington PD SWAT, we took the suspect into custody. Great job by our team and federal partners! This guy was dangerous,” tweeted Arlington Police Chief Will Johnson.

DALLAS (CBSDFW.COM/AP) — A prosecutor says a Dallas-area man mistaken for a thief last year as he tried to unlock his own truck had his hands in the air and was begging not to be shot when a police officer shot him twice.

Dallas County prosecutor Bryan Mitchell told jurors Tuesday during opening statements in the trial of former Mesquite officer Derick Wiley that Lyndo Jones was struck in the back as Jones backed away.

Wiley, who was subsequently fired from the department, is charged with aggravated assault in the November 8 shooting. Jones sustained injuries that required repeated hospital stays.

Lyndo Jones

Authorities have said Jones was shot after officers responded to a report of someone breaking into a vehicle, setting off its alarm.

Body cam video from the incident was played for jurors during the trial Tuesday.

It showed Wiley responding and ordering Jones to the ground after finding him in the truck.

Jones goes to the ground but eventually gets up and appears to start running before turning and pleading not to be shot.

Jones’ attorney said Wiley placed his foot on Jones’ neck, causing a pain that prompted Jones to get back to his feet.

A lawyer for Wiley said the officer was forced to make a split-second decision after being led to believe the suspect was burglarizing the truck. Video played for the jury showed Wiley telling investigators that he thought Jones was armed. “I thought he was going to kill me,” Wiley said.

Authorities determined Jones did not have a weapon.

The civil attorney for Jones said the body cam video shows a police officer committing a crime.

“Clearly, there was no need for this type of force,” said Daryl Washington. “You can hear Lyndo pleading with the officer, don’t harm him. So there was absolutely no reason to use deadly force at that time.”

The trial is expected to last through the week.

The aggravated assault charge carries a sentence of between five years and life in prison and up to a $10,000 fine.

District Attorney Faith Johnson previously said her office will “seek the maximum” sentence.

A federal civil lawsuit was filed in January against the City of Mesquite and former officer Wiley.

The lawsuit accuses Wiley of shooting Jones.

The lawsuit states that Wiley screamed expletives at Jones while grabbing him by the neck and pointing a gun at his head.

DALLAS (CBSDFW.COM) – The man shot twice in the back by a Mesquite Police officer ten months ago, testified Wednesday during the criminal trial against fired officer Derick Wiley.

“I tell you don’t shoot me, and you shot me,” Lyndo Jones said before a Dallas County jury.

Jones recounted the evening he was sitting on his truck in a Mesquite parking lot. He admitted to smoking marijuana and cocaine, when he he heard the voice of a man cursing him. “He said, I will f…ing (expletive) shoot you. I was scared. I didn’t know he was police,” Jones testified.

Wiley, his hands and voice captured in body cam video shown to jurors, has his gun drawn, loudly commanding Jones to get out of his truck and get on the ground. The video records Jones responding with “Yes sir” and “Don’t shoot me” statements during the ordeal.

As Wiley has Jones on the ground, Jones asks, “What are you doing?”

He frees himself from Wiley’s hold while on the ground, and attempts to run away. Wiley fires two shots. Both hit Jones.

In another recording, a Mesquite Police investigator listens to Wiley’s narrative of the shooting incident.

“When he swung up his hands, I thought there could be a weapon. And I thought, he’s gonna kill me. And I fired,” Wiley said.

Prosecutors say the fired police officer used excessive force, and shot a man who was sitting in his own vehicle.

Testimony continues Thursday.

FORT WORTH (CBSDFW.COM) – An illegal immigrant convicted of kidnapping and raping a 6-year-old girl was given four life sentences for the heinous crime.

“What this defendant did is every parent’s worst nightmare. The scars he caused will never go away,” said prosecutor Cami Gildner.

Edis Moya Alas kidnapped the child who was asleep on her living room couch in 2016. Her parents awoke in the night to find her missing, and a large-scale search was immediately launched, bringing together family members, friends, police officers and dozens of volunteers from the community.

Around lunchtime the following day, a volunteer heard cries coming from a wooded area in Titus Paulsel Park and alerted police. As a police officer investigated, the child ran from an area of deep underbrush and lept into his arms. In the country illegally from El Salvador, Alas was found hiding nearby, and he was taken into custody at the scene. Graphic photos were later recovered from his cellphone, and his DNA was found on the girl.

After their daughter was returned to them, the child’s parents were grateful.

“I prayed to God to return her in good health. I didn’t care, as long as I was able to see my daughter,” the child’s mother stated through a translator in 2016. “It was a very difficult time for me. The seconds, minutes seemed like an eternity.”

Alas, who does not speak English and used an interpreter throughout the trial, did not take the stand in his defense.

An emotional Wiley said he feared for his own life when he shot Lyndo Jones, who was in his own truck in a vacant parking lot smoking marijuana.

Wiley said he thought Jones was armed.

“I would not have shot that dude if I didn’t think he had a weapon or was going to hurt me, but I didn’t know what he was doing,” said Wiley. “My intention was to handcuff him. Why? Because I thought he had a weapon.”

Jones’ attorneys said they don’t buy it.

“I think those tears were coached, just as his testimony on the stand,” said Justin Moore, one of Jones’ attorneys.

The state argues you can’t shoot someone because you think they may have a weapon.

DALLAS (CBSDFW.COM) – After closing statements on Wednesday morning, the case of a fired Mesquite police officer accused of shooting an unarmed man is now in the hands of the jury.

The jury in the trial of Derick Wiley must decide if the officer violated law by using deadly force in the shooting or if his actions were reasonable.

Wiley faces five to 99 years if he is convicted in the shooting.

awiley Jury Now Deliberating In Derick Wiley Trial After Closing Statements

In November 2017, Wiley ordered Lyndo Jones to get out of his truck and threatened to shoot him. The whole incident was captured on body cam and shown during the trial.

The two men got into a tussle while Jones was on the ground. As Jones tried to get away, Wiley shot him twice.

Prosecutors told the jury Wiley’s actions as a police officer were unbecoming of an officer and that he used deadly force for no reason.

“The fact the defendant was a police officer does not excuse him for his unreasonable actions that day when he shot Lyndo Jones,” said prosecutor George Lewis. “This was not a reasonable use of force by this defendant.”

The defense said the officer should not be punished for doing his job.

“Please send a message to law enforcement. Send a message to this county that law enforcement does matter. And if more officers are backed up when they’re right then maybe when people are wrong, we will prosecute them. Maybe this will tone down some of the shootings that we have in our own county,” said defense attorney Kathy Lowthorp.

There were references to police shootings by both sides. The primary focus of the jury is the fired Mesquite officer who faces an aggravated assault charge that could put him in prison if convicted.

DALLAS (CBSDFW.COM) – The jury in the aggravated assault trial of former Mesquite Police officer Derick Wiley was unable to reach a verdict and the case has ended in a mistrial.

The jury deliberated all day Wednesday and most of the day Thursday before letting the judge know they could not reach a verdict.

The judge said after eight days of testimony and hours of deliberations, he did not believe a jury could come to a unanimous verdict and declared a mistrial.

Wiley’s attorney told CBS 11 the jury was split 8-4 for acquittal.

“Well, he gets to go home today, not facing prison, that is some relief,” said defense attorney Kathy Lowthorp. “It would’ve been the right answer that this should’ve been not guilty.”

“We respect the jury’s decision,” said Mike Snipes, Assistant District Attorney. “Judge (DA Faith) Johnson will make a decision in the coming weeks (on whether or not to retry the case). Thank you very much.”

The jury was tasked with deciding if the officer violated law by using deadly force in the shooting or if his actions were reasonable.

Wiley faced five to 99 years in the shooting of Lyndo Jones.

The Dallas County DA’s office released the following statement Thursday afternoon:

The DAs Office respects the jury’s decision. We want to thank them for their service. We appreciate their time and diligence in listening to the evidence presented.

“My office remains committed to fighting for justice no matter who is accused of a crime. Let there be no doubt, that this office will never show any special consideration for anyone regardless of the position they hold in society. Our track record makes it abundantly clear with every case we handle that we will continue to fight for the citizens of Dallas County,” said Dallas County District Attorney Faith Johnson.

On November 8, 2017, Officer Wiley was accused of shooting Jones twice in the back following a patrol stop and subsequent check of Jones and his vehicle which was stopped in the 1300 block of south Town East Blvd. Wiley ordered Jones out of the vehicle and onto the ground. Jones claimed he feared for his life and ran. Wiley said he thought Jones might have a weapon and shot him, although no weapon was ever displayed.

The District Attorney’s Office wants to commend the trial team that included lead prosecutor Assistant District Attorney Bryan Mitchell, ADAs George Lewis, Mischeka Nicholson, Jason Hermus and Doug Gladden from the Appellate Division for their hard work and dedication on this case.

He denies the allegations.

Prosecutors say the attack was captured on security system video at Boykin’s home in Mansfield.

The investigation into the alleged assault began on March 21, when officers received a call from Parkland Hospital in Dallas, about a woman who’d been assaulted in Mansfield.

Boykin’s girlfriend, Shabrika Bailey, reportedly suffered a broken jaw that had to be wired shut among other injuries.

The Seattle Seahawks released the 24-year-old Boykin from the team’s practice squad shortly after reports of the attack surfaced.

It’s not Boykins’ first run-in with the law.

He was arrested in Dallas last year on misdemeanor charges of public intoxication and marijuana possession, though the case was later dismissed.

In 2016, he pleaded no contest to resisting arrest stemming from an incident shortly before the 2015 Alamo Bowl in San Antonio.

He was suspended for that game and was sentenced to a year of deferred adjudication probation.
